This notice describes how medical and substance use disorder treatment information about you may be used and disclosed, how you can access this information, and the privacy rights available to you. Please review it carefully.
Salterra OC Detox & Treatment is committed to protecting the privacy and confidentiality of your health information. This Notice applies to protected health information maintained by Salterra and to substance use disorder patient records protected by 42 CFR Part 2, when applicable.

YOUR RIGHTS
When it comes to your health information, you have certain rights. Salterra has responsibilities to help you exercise those rights.
Get a Copy of Your Health Record
You may ask to inspect or receive an electronic or paper copy of your medical or treatment record and other health information we maintain about you.
We will respond to your request within the time required by applicable law. A reasonable, cost-based fee may apply when permitted by law.
Ask Us to Correct Your Health Record
You may ask us to correct health information that you believe is incorrect or incomplete.
We may deny certain requests when permitted by law, but if we do, we will explain the reason in writing and describe any additional rights available to you.
Request Confidential Communications
You may ask us to contact you in a specific way or at a specific location.
For example, you may request that we contact you only through a particular telephone number, email address, mailing address, or other approved method.
We will accommodate reasonable requests as required by law.
Ask Us to Limit What We Use or Share
You may ask us not to use or disclose certain health information for treatment, payment, or health care operations.
We are not required to agree to every request unless the law requires us to do so.
If you pay for a health care service or item completely out of pocket, you may ask us not to disclose information about that service to your health insurer for payment or health care operations. We will honor the request unless disclosure is required by law.
Additional restrictions apply to substance use disorder patient records protected by 42 CFR Part 2.
Get a List of Certain Disclosures
You may ask for an accounting of certain disclosures of your health information made during the period permitted by law.
The accounting may not include every disclosure, including certain disclosures made for treatment, payment, health care operations, or disclosures you specifically authorized, as permitted by law.
Different accounting requirements may apply to electronic Part 2 records as federal requirements are implemented.

You may request a paper copy of this Notice at any time, even if you previously agreed to receive it electronically.
A current copy is also available on our website.
Choose Someone to Act for You
If another person has legal authority to act on your behalf, such as a legal guardian, health care agent, or other authorized personal representative, that individual may exercise applicable privacy rights for you.
We will verify that the person has appropriate authority before acting on the request.
File a Privacy Complaint
You may file a complaint with Salterra if you believe your privacy or confidentiality rights have been violated.

Salterra will not retaliate against you for filing a complaint or exercising your privacy rights.
YOUR CHOICES
For certain health information, you may tell us what you prefer regarding how information is shared.
Family Members, Friends, and Others Involved in Your Care
Where permitted by applicable law, you may tell us whether and to what extent we may share relevant information with a family member, friend, caregiver, or other person involved in your care.
Because substance use disorder treatment information may be protected by 42 CFR Part 2, additional written authorization may be required before Salterra can confirm your participation in treatment or disclose information about your care.
Disaster Relief or Emergency Situations
Information may be used or disclosed as permitted by applicable law when necessary in an emergency or disaster situation.
Special requirements apply to records protected by 42 CFR Part 2.
Marketing
Salterra will obtain authorization when required by law before using or disclosing protected health information for marketing purposes.
Salterra does not sell your protected health information.
Fundraising
If Salterra conducts fundraising activities using information in a manner permitted by law, you will have the right to opt out of future fundraising communications.
Substance use disorder records protected by 42 CFR Part 2 are subject to additional requirements regarding fundraising communications.
HOW WE MAY USE OR DISCLOSE YOUR HEALTH INFORMATION
HIPAA permits certain uses and disclosures of protected health information without a separate authorization.
Records protected by 42 CFR Part 2 receive additional confidentiality protections. Salterra will obtain your written consent for uses and disclosures of Part 2 records when required by federal law.
Treatment
We may use health information to provide, coordinate, or manage your care and may share information with health professionals involved in your treatment as permitted by applicable law.
For example, information may be used to coordinate treatment with an authorized physician, therapist, counselor, pharmacy, laboratory, or other health care professional.
When information is protected by 42 CFR Part 2, appropriate patient consent or another legally permitted basis for disclosure will be obtained as required.
Payment
We may use and disclose health information as permitted by law to obtain payment for services, verify benefits, process claims, or communicate with health plans or other responsible payers.
When Part 2 applies, Salterra will obtain the consent required for disclosures involving protected substance use disorder records.
Health Care Operations
We may use health information for legitimate health care operations such as:
Quality assessment and improvement
Staff supervision and training
Licensing, accreditation, and regulatory activities
Compliance activities
Business administration
Auditing
Care coordination
Evaluating program performance
Part 2 information will be used or disclosed only as permitted under applicable Part 2 requirements.
OTHER USES AND DISCLOSURES PERMITTED OR REQUIRED BY LAW
Depending on the circumstances and applicable confidentiality laws, health information may be used or disclosed for purposes including:
Public Health and Safety
Information may be disclosed when permitted or required by law for certain public health activities, such as reporting communicable disease or other legally reportable conditions.
Abuse, Neglect, or Threats to Health or Safety
Information may be disclosed when permitted or required by applicable law regarding suspected abuse, neglect, or circumstances involving a serious threat to health or safety.
Additional protections may apply to behavioral health and substance use disorder information.
Health Oversight and Regulatory Activities
Information may be provided to authorized oversight agencies for activities such as licensing, certification, audits, inspections, investigations, and other legally authorized regulatory functions.
Research
Health information may be used or disclosed for research only when the applicable requirements of HIPAA, 42 CFR Part 2, and other relevant laws have been satisfied.
Medical Examiners and Funeral Directors
Information may be disclosed to coroners, medical examiners, or funeral directors when authorized by law and consistent with applicable confidentiality protections.
Workers’ Compensation and Government Programs
Information may be disclosed as permitted or required by applicable law for workers’ compensation programs and certain authorized government functions.
Legal Proceedings and Law Enforcement
Health information may be disclosed in response to legal process only when the requirements of applicable law have been satisfied.
Substance use disorder patient records protected by 42 CFR Part 2 receive special protection. Part 2 records generally may not be used or disclosed in civil, criminal, administrative, or legislative investigations or proceedings against a patient based on the content of those records without the patient’s specific written consent or a court order and subpoena meeting applicable federal requirements.
SPECIAL PROTECTIONS FOR SUBSTANCE USE DISORDER RECORDS
Federal law provides additional confidentiality protections for certain substance use disorder patient records under 42 U.S.C. § 290dd-2 and 42 CFR Part 2.
When Part 2 applies:
Salterra is required to protect the confidentiality of your substance use disorder patient records.
Salterra must obtain your consent for most uses and disclosures unless a disclosure is otherwise specifically permitted by law.
A consent may authorize certain future uses and disclosures for treatment, payment, and health care operations as permitted by current federal law.
You may revoke your consent as permitted by law.
Substance use disorder counseling notes maintained separately from the rest of the patient record require separate authorization when required by Part 2.
Part 2 records generally may not be used against you in a civil, criminal, administrative, or legislative proceeding without your specific written consent or an appropriate court order and subpoena.
Salterra may not condition treatment on your consent to use Part 2 records in a civil, criminal, administrative, or legislative investigation or proceeding against you.
HHS confirms that the revised Part 2 rules allow a single consent for certain future treatment, payment, and health-care-operations disclosures while preserving heightened protections against use of SUD records in proceedings against the patient. (HHS.gov)
SUBSTANCE USE DISORDER COUNSELING NOTES
Certain substance use disorder counseling notes maintained separately from the remainder of your Part 2 record receive additional protection.
When required by law, Salterra will obtain a separate, specific written consent before using or disclosing these counseling notes.
CALIFORNIA PRIVACY PROTECTIONS
California law may provide additional confidentiality protections for medical, behavioral health, and substance use disorder information.
Salterra follows applicable California confidentiality requirements, including the California Confidentiality of Medical Information Act (CMIA) and other state privacy laws that apply to the information we maintain.
Where California law provides greater privacy protection than federal law, Salterra will follow the more protective applicable requirement.
California DHCS recognizes that SUD records may be subject to Part 2 as well as other state and federal privacy requirements. (Cal DHCS)
ELECTRONIC COMMUNICATIONS
Email, telephone, text messaging, electronic health records, and other electronic systems may be used in connection with treatment and program operations when permitted by law.
Salterra uses administrative, technical, and physical safeguards designed to protect confidential information.
You may request reasonable alternative methods of communication if you have privacy concerns.
OUR RESPONSIBILITIES
Salterra is required to:
Maintain the privacy and security of protected health information and protected substance use disorder records.
Provide you with notice of our legal duties and privacy practices.
Follow the terms of the Notice currently in effect.
Notify affected individuals as required if a breach occurs that may compromise the privacy or security of protected information.
Obtain authorization or consent for uses and disclosures when required by law.
Respect the additional confidentiality protections applicable to Part 2 records.
Provide you with a copy of this Notice upon request.
HHS's current Part 2 notice requirements specifically require programs to inform patients of their privacy duties, breach-notification obligations, complaint rights, contact information, and the effective date of the notice. (HHS.gov)
USES OR DISCLOSURES NOT DESCRIBED IN THIS NOTICE
Salterra will not use or disclose your protected information for purposes not described in this Notice unless you provide written authorization or another basis permitted by law applies.
If you provide written authorization, you may revoke that authorization in writing as permitted by law.
Revocation does not affect actions already taken in reliance on a valid authorization.
CHANGES TO THIS NOTICE
We may change the terms of this Notice and our privacy practices.
Changes may apply to information we already maintain as permitted by law.
